THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION.
1. Our Commitment to Your Privacy
At A Plus Community Counseling Services, we are committed to protecting the confidentiality of your health information. We provide a wide range of services including individual therapy, DOT/SAP evaluations, and intensive outpatient programs (IOP). This policy applies to all services provided at our Las Vegas office and via our teletherapy platform.
2. Special Protections for Substance Use Records (42 CFR Part 2)
Because we provide specialized substance use disorder (SUD) services and SAP evaluations, your records are protected by additional federal laws. Per the 2026 HIPAA/Part 2 Integration Rule:
- Restrictive Use: Your SUD records cannot be used in criminal charges or investigations against you without a specific court order or your written consent.
- SUD Counseling Notes: Notes from your addiction counseling sessions are kept separate from your general medical record for enhanced privacy.
- Single Consent: You may sign a single consent form for the disclosure of your records for Treatment, Payment, and Health Care Operations (TPO), which we will maintain for the duration of your care.
3. DOT & SAP Evaluation Data
If you are receiving a Department of Transportation (DOT) Substance Abuse Professional (SAP) evaluation, please be aware:
- Reporting Requirements: We are required to report certain information to the DOT Clearinghouse and your employer/employer’s representative as mandated by federal law.
- Consent: Specific SAP-related disclosures will be outlined in your intake paperwork, and by participating in these evaluations, you acknowledge these required federal reporting pathways.
4. Website Data & Teletherapy (aplusnv.com)
- Website Security: We use industry-standard encryption to protect information submitted through our contact forms on aplusnv.com.
- Teletherapy: Our teletherapy sessions are conducted via HIPAA-compliant platforms. We do not record video or audio sessions without your express written permission.
- Cookies: Our website may use cookies to improve user experience; however, these do not track or store your clinical health information.
5. Your Nevada Privacy Rights
Under NRS 629.061, you have the right to:
- Access Records: Request a copy of your records, which we will provide within the timeframe required by Nevada law.
- Limit Disclosure: Request that we not share information with your insurance provider if you have paid for a session in full out-of-pocket.
- Notice of Breach: Be notified immediately if there is a breach of your unencrypted personal information.
