15 Sep Failed a DOT Drug Test? Here Is Exactly What Happens Next
The short answer
The moment a DOT drug test comes back positive, you are removed from safety-sensitive duties, and you cannot return until you complete the return-to-duty process with a qualified Substance Abuse Professional. That is federal rule, not your employer’s choice. Here is exactly what happens next, step by step, and what to do first.
First, you are pulled from safety-sensitive work
This happens the same day, and it is not up to your employer. Under the federal rule, a positive result, a refusal, a tampered sample, or a no-show all count as violations that remove you from driving or other covered duties immediately.
The violation is recorded in the Clearinghouse
For CDL drivers, the violation is entered in the FMCSA Clearinghouse. It stays there as unresolved until you complete the return-to-duty process, which is exactly what shows future employers that you are compliant.
Your employer gives you a SAP list, but you choose
Your employer must provide the name of a qualified Substance Abuse Professional, or a list of them. You are not required to use anyone specific, as long as the professional meets DOT qualifications. The choice is yours.
You complete a SAP evaluation
The SAP interviews you about your history and the violation, then recommends education, treatment, or both. Only a DOT qualified SAP can perform this evaluation and guide the process. A regular therapist or doctor cannot sign off on it.
Then education or treatment, and a follow-up evaluation
You complete the recommended program and return to the SAP for a follow-up evaluation. If the SAP agrees you are ready, they clear you for the next step.
Finally, the return-to-duty test and follow-up testing
Your employer arranges a return-to-duty test. Once you pass, the SAP sets an unannounced follow-up testing schedule that includes at least six tests in the first year and can run up to five years.
What to do in the first 48 hours
Do not wait. Contact a qualified SAP and book the evaluation as soon as you can, because every week without it is a week off work. A Plus often offers same-week SAP evaluations by secure video, so you can start the process quickly from anywhere in Nevada.

Frequently asked questions
Will I lose my CDL permanently?
No. The violation stays in the Clearinghouse, but completing the return-to-duty process is what lets you drive again.
Can I use any SAP I want?
Yes, as long as the professional meets DOT qualifications. You are not tied to anyone your employer prefers.
How fast can I start?
Often the same week. Booking the evaluation quickly is the best way to shorten your time off the road.
Do I have to tell future employers?
DOT employers can see unresolved violations in the Clearinghouse. Finishing the process is how the record shows you are compliant.
Is a refusal treated like a positive test?
Yes. A refusal, a tampered sample, and a no-show are all violations that trigger the same process.
